Almost Heaven Cattery (Seller) agrees to sell Buyer the kitten(s) described below for a price of $_________. This includes a non-refundable deposit of $__________ paid on (date) _______. Buyer Agrees to the following conditions: *This kitten is intended to be a household pet. Spaying or neutering is required before 7 months of age. Buyer agrees that this kitten was purchased as a pet and must be spayed or neutered before the age of 7 months or pay a penalty of $800.00 including all court costs in the Seller’s county and state of residence, on the day following the kitten’s 7 month birthday, which in this case is______________. *Buyer assures and guarantees that this kitten will not be used for breeding or stud and not allowed to produce offspring. Registration papers will be held until Buyer has provided Seller with a valid statement as proof of spay/neuter signed by a licensed veterinarian. Seller agrees to sign this kitten’s registration papers over to Buyer within 30 days of receipt of appropriate documentation. *The Buyer agrees to keep this kitten in a clean and pleasant environment, with proper nutrition, health care, and companionship. Under no circumstances will this kitten be sold, leased or given to any pet shop, research laboratory or similar facility. This kitten is sold as an indoor pet and shall never be allowed to roam freely outside. *This kitten should not be surgically de-clawed nor undergo a tendon-cutting procedure. If Buyer has the kitten de-clawed or has a tendon-cutting procedure the Health Guarantee hereunder shall be null and void. * The kitten should be quarantined during a 72 hour period and be gradually introduced to its new environment and surroundings as well as other animals.
Health Guarantee: Seller is transferring this kitten to new owner in good faith as a healthy and well cared for animal. The cat/kitten is guaranteed to be of sound health upon arrival. It is guaranteed for a period of 72 hours from the time of purchase (arrival) if vet-checked within that time. It is recommended that the new cat/kitten be in quarantine during this time. If it is found to be medically deficient with an untreatable or life-threatening problem, it must be reported to the seller immediately. Upon its return, it will be replaced with another kitten of equal value or the purchase price will be refunded within 90 days at the option of the breeder. If no replacement is available at that time, seller will have one year to furnish a satisfactory replacement. The kitten cannot be returned after the guarantee period has expired and /or if it has been exposed to another cat which has not been currently tested for FeLV and FIV. Breeder will not honor any health guarantee if the kitten is dies of a virus from contact with another animal after leaving this cattery. The kitten is guaranteed against congenital defects for one year. Should the kitten die within that time as a direct result of a congenital defect, the kitten will be replaced only if an appropriate autopsy is performed by a licensed veterinarian and veterinarian certificate is provided as proof of cause of death. A replacement will be made of a kitten of comparable quality and value at the discretion of the breeder. Seller will have one year from the date of return to provide new owner with a comparable replacement. Breeder will not be responsible for any veterinary bills of this kitten after leaving the Breeder’s residence and are the responsibility of the new owner. No guarantee or warrantees for this kitten are provided other than those previously mentioned above. The Seller does not guarantee the size, appearance, temperament, and personality of said kitten. after it leaves the cattery or as an adult.
Refunds: Absolutely NO REFUNDS given other than those mentioned in the health guarantee. Do not ask for a refund other than due to health reasons. The Seller does not guarantee the size, appearance, temperament, and personality of said kitten after it leaves the cattery or as an adult. The seller is not responsible for the outcome of the bonding process and experience with the new owner and will not be held accountable in any way or form for the behavior of the kitten after it leaves this cattery. No refunds will be given as the result of the Buyer changing his/her mind if they feel the kitten isn’t working out. The kitten cannot be returned after the guarantee period has expired and /or if it has been exposed to another cat which has not been currently tested for FeLV and FIV. Undesirable behavior issues (spraying, inappropriate urination, defecation, scratching furniture, meowing, aggression, etc...) developing once the kitten has been turned over to the purchaser are not conditions for return or refund. We do not refund money for behavior issues as they are out of our control after the kitten is in its new home. All deposits are non-refundable. ALL SALES ARE FINAL! Seller Recommendations: The kitten should be isolated from other pets for at least three- four days to acclimate to its new surroundings and avoid stress. Keep your kitten confined to a small area until he/she gets used to their new environment and then gradually introduce them to other areas. This helps with litter training as well. Your kitten will be stressed and may be very vocal for a few days. This is normal. Kittens will meow for their mother and siblings. Each kitten will differ in time needed to bond with its new family. Please give your kitten ample time to adjust and expect some noisy days and nights. There are some good products to help calm stressed animals. Feliway and Bach’s Rescue Remedy are good choices if needed and are found at Petco or pet stores. Any changes to the kitten’s diet should be made slowly over a period of a week as sudden diet changes may result in episodes of diarrhea. Your kitten has been fed Royal Canin kitten food. You can find this at Petco or at any specialty pet store. Water your kitten with bottled water for about a week! The sudden change in water can cause episodes of diarrhea. Make a slow transition to the water of your choice by slowly mixing a little with the bottled water over a period of a week. The kitten should be given frequent and kind human attention, providing the kitten with a generous amount of play and exercise such as cat trees, toys and scratching posts. It’s also a good idea to give your kitten its own warm place to sleep such as a cat bed or soft blanket. The kitten should not be caged with the exception of short-term confinement if necessary.
This contract is legally binding to all parties involved. It applies only to the buyer and seller in this transaction and is non-transferrable to other parties. Purchaser's signature indicates full understanding and agreement to the above terms and conditions of the contract. In the event of a legal dispute, legal jurisdiction of this contract shall be in the seller’s county and state.
